PRIVACY POLICY FOR SHUNYA.AI PLATFORM

This Privacy Policy (“Privacy Policy”) applies to your use of our website (“Platform”) and product offered through the Platform (hereinafter collectively referred to as “Offerings”) which are owned, controlled and operated by Shiprocket Limited, a company incorporated under the Companies Act, 1956, having its registered office at Plot No. B, Khasra No. 360, Sultanpur, M.G. Road, New Delhi – 110030, India and its corporate office at Plot No. 416, Phase III, Udyog Vihar, Gurgaon, Haryana – 122002 (“Company” or “Shiprocket”).

For the purposes of these Terms of Use, “we”, “our” and “us” shall mean the Company and “you” and “your”, shall mean a user of the Platform or Services, whether registered or not (“User”).

This Privacy Policy sets out what data we collect and how and why we use it. When you access the Platform or Services you are advised to read the Privacy Policy carefully before accessing any Offerings. To access the Platform or Services, you are required to accept the terms of this Privacy Policy. By accepting this Privacy Policy, you signify that you have read, understood and agreed to be bound by the same. We reserve the right to update or modify this Privacy Policy at any time without prior notice and such changes may be effective immediately. To this end, we request you go through the Policy every time you access or use the Platform or Services.

  • Shunya.AI is committed to protect Users’ privacy and appropriately and responsibly use collected data. By way of this Privacy Policy, we aim to provide a summary of our privacy practices regarding personal data that we collect and process of/about the User through various sources. The primary focus of this Privacy Policy is on the personal data collected and processed. Depending on the purposes of processing and your relationship with us as a data subject, we may provide additional customized privacy policies.
  • This Privacy Policy covers the categories of personal data collected, how we use or process such data, who are the recipients of such data, and your associated rights under applicable laws.

2. DATA WE COLLECT

  • We collect personal data of the User, as detailed further in this clause, and as expressly set forth in this Privacy Policy. While some User data has to be mandatorily provided for your use of the Services, others are optional and certain portions of the data will remain private; Shiprocket will let the User know all of the foregoing categories of data. Additional data may be gathered during subsequent or continued use of our Services.
  • When you create an account with us, we will collect information associated with your account, including your name, contact information, account credentials, date of birth, payment information, and transaction history (collectively, “Account Information”).
  • We collect Personal Data that you provide in the input to our Services (“Content”), including your prompts and other content you upload, such as files, images, and audio, depending on the features you use.
  • When you visit, use, or interact with the Services, we receive the following information about your visit, use, or interactions (“Technical Information”):
    • Log Data: Internet Protocol address, browser type and settings, the date and time of your request, and how you interact with our Services.
    • Usage Data: Types of content you view or engage with, features you use, actions you take, time zone, country, access times, user agent and version, type of device, and connection type.
    • Device Information: Name of device, operating system, device identifiers, and browser used.
    • Location Information: General area from IP address, plus optional precise location if you choose to share it.
    • Cookies and Similar Technologies: Used to operate and administer our Services and improve your experience.
  • Personally Identifiable Information (PII) we may collect while you use our Services:

    • Business Details (GSTIN, PAN, etc.)
    • Email Address, Phone Number
    • Subscription or Payment Details
  • Sources of personal data:
    • Submitted by yourself via Offerings or email/contact
    • Shared with or by employees and affiliates
    • Sales or marketing representatives (including third-party reps), vendors, suppliers
    • Sourced from public websites and social media
    • Cookies and similar tracking technologies
  • We do not collect or store any contact data present on a Device.
  • We do not sell your data to any third party under any circumstance. Data is used to deliver/enhance User experience or improve Offerings.

3. HOW WE USE THIS INFORMATION

  • To provide a meaningful user experience, better usability, troubleshooting, and maintenance of our Platform or Services.
  • To develop and improve our existing Services and create new products and experiences.
  • To communicate with Users, respond to queries or requests.
  • To prevent fraud, illegal activity, or misuse of our Services and protect their security.
  • To comply with legal obligations and protect the rights, privacy, safety, or property of users, Shunya.AI, or third parties.
  • To defend the rights or property of Shunya.AI and the safety of Users or the general public.

  • We will not use User data for any purpose other than in connection with Offerings. We may share User data with required third parties in connection with our Services as required and you explicitly agree to this sharing.
  • We may share user data with third-party vendors and service providers to help us better provide our Offerings (e.g., payment gateways, logistics, maintenance).
  • We may share Personal Data with government authorities or other third parties to comply with the law, protect our rights, prevent fraud, ensure safety, or fulfill legal obligations.
  • We may disclose Personal Data to affiliates of Shunya.AI or Shiprocket group companies, who may use it in line with this Privacy Policy.
  • In the event of strategic transactions (e.g., merger, reorganization, sale), your data may be disclosed and transferred as part of that transaction.

5. COOKIES

When you use/access our Offerings, cookies may be sent to your device to improve Services or store preferences. You can disable cookies via device settings; however, some parts of our Offerings may not function properly. Even if you disable cookies, Shunya.AI may still receive data about your usage or personal data like your email address. We will store data about you for as long as permitted under applicable law.

6. DATA RETENTION

We ensure User data is available only as long as necessary for its purpose or longer if required by law, with appropriate safeguards. All collected data is de-identified. You explicitly consent to our use of such de-identified data freely within the limits of applicable law.

7. YOUR RIGHTS AS A USER

  • Access your Personal Data and information on its processing.
  • Delete your Personal Data from our records.
  • Update or correct your Personal Data.
  • Transfer your Personal Data to a third party (data portability).
  • Restrict how we process your Personal Data.
  • Withdraw your consent where relied on, at any time.
  • Object to how we process your Personal Data.
  • Lodge a complaint with a data protection authority.

9. DATA SECURITY

We implement robust physical, technical, and administrative controls, including encrypted databases, RBAC, and regular security audits. Our practices align with ISO/IEC 27001 and SOC II standards for risk management and disaster recovery.

10. THIRD-PARTY LINKS

When using the Platform, you may be directed to third-party websites or apps. We are not responsible for such third-party sites or their policies. If you share data with them, you are bound by their respective privacy policies.

11. CHILDREN’S DATA

Our Offerings are not intended for children under 18. We do not knowingly collect data from children under 18.

12. UPDATES TO THE PRIVACY POLICY

We reserve the right to change this Privacy Policy at any time. Changes are effective immediately upon publication. Continued use of our Offerings after changes signifies acceptance. We encourage you to review this Privacy Policy regularly.

In the event of any dispute, difference or claim arising out of this Privacy Policy, it shall be settled in accordance with applicable laws in India through regular judicial process, with courts of New Delhi having exclusive jurisdiction.
